While it appears the number of hearings has declined in recent months during the pandemic, VCAT and PPV continue to release noteworthy decisions and reports. Significant Tribunal decisions include reverse living proposals where it would seem the Tribunal has adopted a more relaxed approach; two refusals despite interim orders providing an opportunity to submit amended plans; whether electronic illumination of a sign affects an accrued right; and mandatory garden area requirements exemptions. Significant Panel reports include whether a rezoning should be supported in the absence of a Development Plan; blanket tree control protection; concerns with Moreland’s Integrated Transport Strategy; and concerns with Monash’s proposed public open space contributions.
